Excavation and earthmoving in Mullumbimby

Mullumbimby sits at the foot of Mount Chincogan on the Brunswick River, a country town with a grid of long, narrow lots and rear lanes at its centre. Newer streets around Tallowwood and Left Bank Road run up into hillier country. The 5.5 t Kubota and ASV posi-track that Luke operates suit backyard and lane access, while his Fuso tipper carts spoil out and gravel in.

Ground and access in Mullumbimby

The NSW SES says the town sits where the Brunswick River meets Mullumbimby Creek, and that its flat terrain and shallow riverbank make it highly prone to flooding. In 2022 the river reached 4.97 m at Mullumbimby. Council's Mullumbimby chapter notes many older houses raised to a safe flood level, some flood-prone large-lot land beside town with no sewer, and housing near Orchid Avenue kept north of Saltwater Creek. Regional soil mapping shows poorly drained humic gley soils north and east of town, and steep basalt slopes on the northern side of Coolamon Scenic Drive.

Central lots are long and narrow, and the newer areas around Tallowwood and Left Bank Road make heavy use of battle-axe lots on hilly ground. The Kubota and posi-track can work inside a fenced backyard if the gate or lane opening is wide enough. Send a wide shot of the work area, the gate opening with a measurement, the driveway, and any power lines overhead.

Before you dig in Mullumbimby

Mullumbimby is in the Byron Shire Council area. These rules are worth checking before the machine is booked. Luke lodges his own Before You Dig enquiry for every job.

CheckWhat it means
Excavation and fill limitsWhere earthworks need development consent, Byron's DCP Chapter B14 limits excavation and fill to 1 m deep unless otherwise stated. Earthworks on land steeper than a 15% gradient, or with more than 1 m of cut and fill, need engineering detail from a structural or geotechnical engineer.
Acid sulfate soilsCouncil says acid sulfate soils sit in the coastal floodplains, generally below RL 5 m AHD. Under clause 6.1 of Byron LEP 2014, Class 1 land needs consent for any works and Class 2 for works below the ground surface. On Class 3 and 4 land the trigger is works more than 1 m or 2 m below natural ground, or works that lower the water table that far.
Driveways and the road reserveCouncil needs a permit before any work on a driveway or elsewhere in the road reserve. Even an exempt driveway needs Section 138 approval under the Roads Act, lodged on the NSW Planning Portal.
Flood-prone landCouncil's floodplain pages cover the Brunswick River, Belongil Creek and Tallow Creek, and much of the shire's low ground can flood. Check the flood maps before any fill or drainage work on the flats.
Near creeks and natural waterExempt earthworks must be at least 40 m from natural water and must not redirect water or send sediment onto a neighbour's land.

Questions about earthworks in Mullumbimby

Can Luke's tipper use my rear lane?

It depends on the lane. Council's Mullumbimby chapter describes the town's rear lanes as narrow and treats their overhanging trees as part of their character. The Fuso needs room to back in, firm ground to tip on, and clearance from branches and wires. Send photos looking both ways down the lane and of your back gate, and Luke will say whether the tipper or only the smaller machines can come in that way.

Who do I ask about earthworks approvals in Byron Shire?

Byron Shire Council's Development Support Officers answer approval questions on 02 6626 7025. Get any approval the job needs, or confirm the work is exempt, before the machine is booked. The council approval guide sets out the Tweed, Byron and Ballina rules side by side.
