Excavation and earthmoving in Newrybar

Historic Newrybar sits on the Old Pacific Highway, 16 km south of Byron Bay, with rural roads running out from its main street into open farmland and horticulture. A 2014 character statement prepared for Ballina Shire Council also notes elevated, good quality farmland with views to the ocean. For farm and rural home jobs around the village, Luke brings the posi-track for tracks, the Kubota for drains and clearing, and the Fuso for gravel.

Ground and access in Newrybar

The village sits at about 123 m, and NSW topographic contours across the locality run from 150 m down to 10 m. Emigrant Creek starts in the north of Newrybar and runs south-west toward Knockrow, Skinners Creek runs along or near the northern edge, and the Newrybar Drain follows the south-eastern edge. With that much fall, runoff decides where a new track, culvert or drain can go, and Luke reads the slope from your photos before quoting.

Through the village, the Old Pacific Highway is the main street. Council adopted a streetscape master plan in July 2025 that proposes making it one way between Brooklet Road and Hinterland Way, though no funding has been secured yet. For a farm job, send a photo of the gate, the track to the work and the spot itself, and say where a loaded tipper can turn.

Before you dig in Newrybar

Most of Newrybar, including the village, is in Ballina Shire, but its northern edge is in Byron Shire, so check your rates notice. The table shows the Ballina Shire Council rules. These rules are worth checking before the machine is booked. Luke lodges his own Before You Dig enquiry for every job.

CheckWhat it means
Acid sulfate soilsBallina Shire Council asks anyone planning excavation, or works that could lower the water table, on or next to the floodplain (below 10 m AHD) to check its acid sulfate soil risk maps first. Clause 7.1 of Ballina LEP 2012 needs consent for set works on land mapped Class 1 to 5, depending on the class and depth.
Bringing in fillCouncil says bringing in fill needs development consent in most cases, including before Council's own surplus fill is delivered. On flood-liable land, applications for earthworks or filling need a survey plan with levels to AHD.
Removing treesA Private Tree Permit, lodged through the NSW Planning Portal, must be issued before work starts. On RU1 and RU2 rural land, clearing may need approval under the Local Land Services Act 2013 instead.
Driveway crossingsBuilding, repairing or changing a driveway crossing needs section 138 consent from the roads authority, usually Council. It is separate from any DA or CDC.
Sediment and runoffCouncil warns that letting soil or sediment pollute waterways is an offence. Erosion and sediment controls should be checked daily and before and after rain.

How it works

  1. Call or text Luke a photo

A wide shot, the gate or access, and the exact spot tells him most of what he needs.

  2. Get a free quote

From your photos, or from a quick site look if the job needs it. No charge for either.

  3. Book a day

Luke brings the right machine for the access and the job.

  4. Dig, cart and clean up

Spoil goes out on his own tipper. The site is left tidy.

Questions about earthworks in Newrybar

Is my Newrybar property under Ballina or Byron council?

It depends where it is. Newrybar is shared between Ballina and Byron shires. The village is in Ballina Shire, but NSW Spatial Services boundary data puts part of the locality's northern edge in Byron Shire. Your rates notice names your council. Confirm it before a job is booked, because the two councils have different rules for trees, driveways and acid sulfate soils.

Do I need consent to dig on low ground in Ballina Shire?

Possibly. Ballina's LEP needs consent for some works on land mapped for acid sulfate soils, depending on the class and the depth of the dig, and Council asks you to check its risk maps before excavating on or near the floodplain. Check the maps first, and tell Luke the class when you send your photos.
