Excavation and earthmoving in Suffolk Park
Between Tallow Beach and the escarpment west of Broken Head Road, Suffolk Park is a suburb of house blocks. Streets off Clifford Street, east of the road, are low and mostly flat among old dunes and waterways. To the west, Baywood Chase and Byron Hills were master planned in the 1990s on hilly ground with larger lots. In fenced yards Luke uses the compact posi-track or the 5.5 t Kubota, and the Fuso carts the spoil away.

Jobs Luke takes on in Suffolk Park

Trenching and drainage
Storm run-off on the flat dune country east of Broken Head Road needs somewhere to go. Luke lodges a Before You Dig enquiry, digs and backfills the trench, and your licensed plumber lays and connects the stormwater pipe.

Land clearing
Native cypress pine grows in the Suffolk Park locality, and Council's chapter asks for a survey where it is present on a development site. Once you know what can go, Luke removes the trees, stumps and weeds you ask him to.

Soil removal and tipper
Spoil from landscaping and yard clean-ups on Suffolk Park house blocks usually has to leave, as Council maps fill exclusion areas in the Tallow Creek catchment. The Fuso takes it to a lawful tip or approved site, and every load gets a docket.

Excavator hire
Council expects new housing here to come as infill, mainly secondary dwellings and dual occupancies. Builders on those jobs can hire the posi-track or Kubota wet, with Luke driving, for service trenches, landscaping and loading spoil.

Council describes the Tallow Creek catchment as steep to undulating up near the escarpment and shaped by ancient dunes lower down, with drainage lines running parallel to the coast. North, Middle and South Tallow Creek feed Tallow Lake, which opens to the ocean only now and then. Suffolk Park is a flash flood catchment with minimal warning, and in mapped fill exclusion areas Council wants buildings on piers with nothing filled underneath. Its Suffolk Park chapter also flags steep terrain in the western estates.
East of Broken Head Road, expect battle-axe lots, cul-de-sacs and gated enclaves, so gate widths and getting through a shared gate come first. In Baywood Chase and Byron Hills, slope decides where a machine can sit. Send the gate width, a photo from the street to the work spot, and where the Fuso can park safely off Broken Head Road.
Before you dig in Suffolk Park
Suffolk Park is in the Byron Shire Council area. These rules are worth checking before the machine is booked. Luke lodges his own Before You Dig enquiry for every job.
| Check | What it means |
|---|---|
| Excavation and fill limits | Where earthworks need development consent, Byron's DCP Chapter B14 limits excavation and fill to 1 m deep unless otherwise stated. Earthworks on land steeper than a 15% gradient, or with more than 1 m of cut and fill, need engineering detail from a structural or geotechnical engineer. |
| Acid sulfate soils | Council says acid sulfate soils sit in the coastal floodplains, generally below RL 5 m AHD. Under clause 6.1 of Byron LEP 2014, Class 1 land needs consent for any works and Class 2 for works below the ground surface. On Class 3 and 4 land the trigger is works more than 1 m or 2 m below natural ground, or works that lower the water table that far. |
| Driveways and the road reserve | Council needs a permit before any work on a driveway or elsewhere in the road reserve. Even an exempt driveway needs Section 138 approval under the Roads Act, lodged on the NSW Planning Portal. |
| Flood-prone land | Council's floodplain pages cover the Brunswick River, Belongil Creek and Tallow Creek, and much of the shire's low ground can flood. Check the flood maps before any fill or drainage work on the flats. |
| Near creeks and natural water | Exempt earthworks must be at least 40 m from natural water and must not redirect water or send sediment onto a neighbour's land. |

Questions about earthworks in Suffolk Park
My block runs down to Tallow Creek. How close to the bank can work go?
Council's Suffolk Park chapter says that on development applications for land in, next to or near Tallow Creek, as mapped, buildings, parking areas, driveways and other works apart from landscaping and environmental repair must sit at least 10 m from the creek bank, or further if bank stability calls for it. Check your lot against the chapter's map, then Luke can quote once the plans show where the work goes.
Can I add a second driveway onto Broken Head Road?
Council's Suffolk Park chapter treats Broken Head Road as an important arterial road and asks development applications to keep new access points onto it to a minimum. Upgrading or moving an existing access through a development application needs a Traffic Impact Assessment. Get that settled first, and Luke can then quote the earthworks and gravel for the approved layout.
Who do I ask about earthworks approvals in Byron Shire?
Byron Shire Council's Development Support Officers answer approval questions on 02 6626 7025. Get any approval the job needs, or confirm the work is exempt, before the machine is booked. The council approval guide sets out the Tweed, Byron and Ballina rules side by side.
